Please read these terms of sale carefully before placing your order and retain a copy of these terms and your order invoice for future reference.

1. DEFINITIONS 1.1 Buyer: means the person or organisation that agrees to buy the goods and to whom the goods are invoiced.

1.2 Seller: means Dream PC (UK).

1.3 Price: means the price paid for the goods and services, including VAT, delivery of goods and as set out on the order confirmation.

1.4 Order Confirmation: means the document supplied by the Seller to the Buyer setting out all the goods and services to be supplied and the price to be paid including VAT.

1.5 Goods: means the items as set out and detailed on the order confirmation.

1.6 Hardware: means physical and integral components that form part of any product supplied.

1.7 Software: means Software programmes that require installation, by the buyer and require a license for use.

1.8 Consumables: means items that have a limited use, owing to their nature and require renewal, by the Buyer, from time to time.

1.9 Estimated Delivery Date: means the estimated number of working days on which any Computer System is estimated to take to manufacture, test and dispatch.

1.10 Working Day: means any day Monday - Friday 9am - 5pm and specifically excluding bank holidays.

1.11 Delivered & Delivery: means the day on which the Buyer collects the goods or the day on which the goods are delivered to the Buyers address.

1.12 Terms and Conditions: means the contract as set out in this document.

1.13 Contract: means the contract between the Buyer and the Seller and to which these terms and conditions relate.

1.14 Reasonable Period of Time: Time in which the Buyer should examine the goods to ascertain their conformity with the contract.

1.15 Consumer Buyer: means an individual not acting for the purposes of his or her profession.

1.16 Business Buyer: means an individual, company or other organisation acting for the purposes of their profession.

2. FORMAT OF CONTRACT

2.1 These terms of sale apply to all goods supplied by Dream PC (UK), whose registered office is at 40 Ballochmyle, Calderwood, East Kilbride, South Lanarkshire , registered in Scotland No. VAT Reg. No (Awaiting details) (the "Supplier").

2.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us.

2.3 By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken and you receive your acceptance e-mail. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.

2.4 The contract is subject to your right of cancellation (see below).

2.5 The Supplier may change these terms of sale without notice to you in relation to future sales.

3. GOODS Dream PC (UK) sells Custom Built PCs, Media Centres, Laptops, Workstations and PC Components / Peripherals.

3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

3.2 The description and price of the goods you order will be as shown on the seller's website at the time you place your order.

3.3 In addition to the price, you will be required to pay a delivery charge for the goods, as shown in the section of the seller's website about delivery.

3.4 Every effort is made to ensure that prices shown on the Supplier's website are accurate at the time you place your order. If an error is found, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or canceling your order. If the Supplier does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel the order, or if the order is cancelled automatically due to the expiry of the 14 day period, the Supplier will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

4. PAYMENT We do not store any card details on our system.

4.1. Payment for the goods and delivery charges can be made by any method shown on the seller's website at the time you place your order.

4.2. For all orders placed, unless specifically agreed otherwise, payment will be taken before the order will be processed. This includes credit and debit cards, which will be debited at the time when the order is placed and not when the order is dispatched.

4.3 The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyer's shopping cart prior to confirming the order.

4.4 Payment of the price plus VAT and delivery charges must be made in full before dispatch of the Goods.

4.5 The price of the goods and delivery charges are inclusive of VAT (if payable).

4.6 If an order is requested to be cancelled, we aim to cancel and refund it the same business day.

4.7 For credit card payments we currently charge 1.5% surcharge fee.

4.8 We tend not to accept payment form internationally issued credit cards - please contact us for alternative methods of payment.

5. DELIVERY

5.1 Goods supplied within the UK will normally be delivered within 2-7 working days of acceptance of order. This does not apply to custom built computers which normally will be delivered within 5-15 working days. 

5.2 The goods you order will be delivered to the address you give when you place your order.

5.3 For destinations other than mainland UK , the order might take longer to be dispatched/delivered.

5.4 When you sign for the goods (i.e. sign the couriers delivery sheet), you are accepting the goods in the condition that you receive them. Once the goods have been signed for in the condition that you receive them, the liability for any physical damage to the computer is released from the couriers responsibility and becomes yours. IT IS STANDARD PRACTICE TO CHECK THE CONTENTS FOR PHYSICAL DAMAGE BEFORE YOU SIGN FOR THEM AND BY ACCEPTING OUR TERMS AND CONDITIONS YOU AGREE TO ONE OF THE FOLLOWING:

  • If the goods are damaged before you sign for them, you will sign for them as "damaged goods" or according to the condition that they have been received in order to maintain your delivery insurance. If you cannot check the goods before signing for them, you (or the person who signs for them) must sign for them as "unchecked" in order to maintain your delivery insurance.
  • Failure to comply with the terms will void your delivery insurance on the computer, and if there is physical damage you will have to pay for the repair.

5.5 CUSTOM PCs

a)   Dedicated Delivery Driver (Recommended for our PC's that may contain a water-cooling solution.) This way of delivery excludes the risk of getting a dead on arrival (DOA) PC as it is just one single person that handles your PC. The price for such service starts as low as £74.99 ex VAT and normally is £1.10/mile and applies to UK mainland locations only.

b) Overnight Insured Delivery with UPS / CityLink - The price is calculated on checkout and is based on weight and starts from as low as £14.99. Deliveries are done between 08:00 and 18:00 and the goods are insured for the full amount.

5.7 If you would like to collect your order from our premises, after having arranged a suitable date and time with a member of our staff you must bring along with you suitable identification to prove your name and invoice address.

6. RIGHTS OF SELLER

6.1 The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.

6.2 The Seller reserves the right to withdraw any goods from the Website at any time.

6.3 The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

6.4 Subject to 6.5 below, if you are a consumer the Supplier shall not be liable to you for any loss or damage in circumstances where:

6.4.1 There is no breach of a legal duty owed to you by the Supplier or by its employees or agents;

6.4.2 Such loss or damage is not a reasonably foreseeable result of any such breach;

6.4.3 Any increase in loss or damage resulting from breach by you of any term of this contract.

6.5 Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Supplier's negligence or fraudulent misrepresentation.

7. WARRANTIES

7.1 All goods supplied by the Supplier are warranted free from defects for 12 months from the date of invoice. This warranty does not affect your statutory rights as a consumer.

7.2 Where goods are provided with a warranty period greater than 12 months, the first 12 months of the warranty covers all parts and labour costs, where as any subsequent period of the warranty cover only relates to labour costs only. e.g. If a product is sold with a 3 year warranty, the first 12 months covers parts and labour, and the next 24 months covers labour costs only. 

7.3 Goods found to be defective under the warranty will be repaired or replaced with an item of an equal or better performance and equal or better value at the original time the order was placed.

7.4 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage or accident.

7.5 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify the Supplier in writing via the Contact Us section of the website, as soon as possible, but in any event within 3 days of the date you discovered or ought to have discovered the damage, defect or complaint. Failure to do so will mean that the said defect occurred at the time when it is actually reported to us.

7.6 We will NOT accept return of equipment without prior authorization. Damage caused in transit by improper customer repackaging may result in further charge to repair any additional damage. This warranty only covers failures due to defects in materials or workmanship which occur during normal operation by the customer. It does not cover failures due to damage which occurs in shipment, or failures which result from accidents, misuse, abuse, neglect, mishandling, misapplication, alteration, faulty installation, modification, or damage that is attributable to acts of God or civil unrest. we shall not be liable for any indirect, special or consequential loss or damage (including without limitation loss of profits) arising from the use of the product or any breach of this warranty. We reserve the right to refuse to take receipt of any unit which we have reasonable belief has met with any of the aforementioned conditions.

7.7 Additional Conditions for return

7.7.1 The PC must be adequately packaged in it's original packaging with all polystyrene protection still in place.

7.7.2 The packaging must be adequately sealed using parcel tape or tape of similar durability and quality.

7.7.3 All original manuals and driver discs are to be returned with the PC. Additional connectors are not required.

7.7.4 If your system shipped with an operating system, please ensure that the original OS disc and serial are returned with the PC.

Exclusions from this warranty • Consumables and accessories
• Non surge protected units.
• Units that have had warranty stickers removed or display evidence of internal tampering or non authorised work by another vendor.
• Electrical work external to the equipment.
• Failure of magnetic data
• Consequential loss of data
• Printers and scanners
• Software/Driver support or configuration
• Monitors, keyboards, mouse and audio speakers

8. YOUR RIGHT OF CANCELATION

8.1
The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller within 7 working days of delivery confirming in writing if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.

8.2 To exercise your right of cancellation, you must provide notice to the seller by writing to Dream PC (UK), 40 Ballochmyle, East Kilbride, South Lanarkshire, G74 3RU, giving details of the goods ordered and (where appropriate) their delivery.

8.3 Refunds cannot be given for any software purchased that has been opened (i.e. seal or outer packaging removed) or activated, as activated software is tied to the user and computer used to activate it. Providing the operating system (i.e. Windows XP) has not been activated, a refund will be issued for the operating system on canceling the contract.

8.4 Custom PCs: Any computer system ordered from us can be cancelled at no charge before the order enters the processing change. During the first 24 hours of the order being processed there is a 12.5% cancellation charge and following that, the cancellation charge is 25% from the total amount of order amount if such action is being requested by the customer

8.5 An order cancelled in transit will incur the standard cancellation fee plus additional transit costs at the expense of the customer.

8.6 In the event of an order returned due to non-delivery, the transit costs will be at the expense of the customer.

8.7 Any orders that are returned within the 7 working day cooling off period will be subject to the costs of recovering the goods. This includes but not limited to the cost of packaging the goods, delivering the goods, collecting the goods and other recovery costs.

9. DATA PROTECTION 

9.1 The Supplier will take all reasonable precautions to keep the details of your order and payment secure but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you.

9.2 The seller will only use the information you provide about yourself for the purpose of fulfilling your order.

10. IMAGES

10.1 Product images are for illustrative purposes only and may differ from the actual product.

11. LAW

11.1 These terms of sale and the supply of the goods will be subject to Scottish law, and the Scottish courts will have jurisdiction in respect of any dispute arising from the contract.

11.2 We are strictly adhering to the current legislation and are trading under the Sale of Goods Act 1979 (as amended by the Sale and Supply of Goods Act), Consumer Protection (Distance Selling) Regulations and Data Protection Act 1994 (as ammended).

11.3 The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
